Everbrite Limited Warranty

All products manufactured by Everbrite, its divisions and subsidiaries, are warranted to be free from defects in material and workmanship for a period of one year from date of shipment, unless otherwise specified. Lamps and breakage of neon glass are excluded from coverage of this warranty. Ballasts and transformers carry a separate Ballast Manufacturer’s Warranty.

Everbrite's obligation hereunder is limited to return, repair, replacement or refund of product only, at its election. If a particular product is found to be inoperative or defective, permission and instructions as to where it should be sent MUST be obtained from the Customer Service Department. Only then should it be returned to one of our locations. All items are to be returned via transportation prepaid. Ballasts should be exchanged under warranty at local electrical supply stores.

All products must be installed and operated in accordance with the manufacturer’s recommended procedures and guidelines. Improper use or installation could void this warranty.

This warranty does not cover loss or damage due to accidents involving the product, acts of criminal aggression, other property disasters or acts of God, or normal wear and tear.

Except for those warranties specifically and expressly set forth above, seller disclaims any and all warranties expressed, implied or statutory, including but not limited to, all warranties of merchantability and fitness for a particular purpose.

Provisions of Warranty

1) Limited Warranty and Remedy: Warranties do not cover the following conditions: damage or defects caused by the failure to provide a suitable and responsible installation environment for the product; damage caused by impact from other objects, vandalism, damage or defects resulting from acts of nature, misuse, abuse, mishandling, misapplication or faulty wiring; damage or defects caused by disturbances or surges in the electrical service; unauthorized attachments, alterations or modifications; or improper maintenance. Under no circumstances shall Everbrite be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict liability, or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of revenue, loss of use of the Everbrite product or any associated or connected product or equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, down time, purchaser’s time, or the claims of third parties.

2) Labor Warranty/Preapproval Requirements: For products manufactured and installed by Everbrite, the warranty includes labor for a one year period after installation. Service work must be pre-approved by Everbrite and provided by an Everbrite authorized service contractor. Any rework of product in the field for the remainder of the original warranty or 90 days, whichever is longer.

3) Freight Claims: Customer is responsible for immediately opening carton and inspecting for concealed damage. Carrier must be notified within 5 days of any damage. Everbrite will warranty shipping damage not covered by the carrier, but only if the carrier was notified within the 5 day period. Products must be returned to Everbrite prepaid.
